Abstract

The article is devoted to questions of transformation of punishment essence and its aims in the XIX century in direction from punishment to measures of safety. Actualization of social defence conception and renewal of concept «dangerous criminal» or «criminal on habit» in the modern criminal statute of foreign countries is analyzed.
